      barry-300Hawk Barry joined the California lemon law firm of Rosner, Barry & Babbitt, LLP in 2002, and was made a partner in 2006. Mr. Barry is a California Lemon Law lawyer who has more than 10 years of consumer protection litigation experience. He has served as trial counsel in numerous auto fraud and lemon law cases resulting in punitive damage and civil penalty awards across Southern California, including San Diego County, Orange County, Los Angeles County, Riverside County, San Bernardino County, Kern County, and Imperial County.

      Most recently, Mr. Barry obtained a jury verdict in favor of a consumer against a car dealership for lumping license and registration fees and failing to disclose a malfunctioning odometer. Mr. Barry runs the firm’s California state-wide dealership class-action department, and has helped vehicle purchasers and lessees recover millions of dollars through settlement and trial.

      Mr. Barry has successfully certified classes of consumers who were victims of auto fraud for the following:

      • Backdated purchase contracts
      • Improper smog fee charges
      • Improper tire fee charges
      • Improperly disclosed negative equity
      • Improper DMV fees

      • Watkins v. Power Toyota Buena Park (backdating)
      • Gains v. Bosch Kia (undisclosed prior rental and accident damage)
      • Graciano v. Robinson Ford Sales (undisclosed negative equity and failure to provide Spanish-language documents)
      • McClanahan v. Fleetwood and Freightliner (lemon law claim)
      • McLucas v. Autoville Motors (failure to comply with buy-here, pay-here law; seller unmeritable vehicle)

      Mr. Barry was also the lead attorney in Graciano v. Robinson Ford Sales, Inc. (2005) 144 Cal.App.4th 140, Lewis v. Robinson Ford Sales, Inc. (2007) 156 Cal.App.4th 359, Nelson v. Pearson Ford Co. (2010) 186 Cal.App.4th 983 which involved California auto fraud issues. Mr. Barry has spoken at multiple National Association of Consumer Advocates Auto Fraud Conferences, and has spoken before the United States Navy JAG attorneys on California auto fraud and lemon law issues.

      Mr. Barry received his undergraduate degree from Duke University in 1992, and graduated from the University of Southern California Law Center in 1995. Mr. Barry has been admitted to practice before both state and federal courts in California since 1995.
